Terms of Use and Sale Agreement

Transaction Terms

All online payment transactions are processed securely through USA Sport Group, LLC on www.USAsportGroup.com using Authorize.net as the dedicated payment gateway on behalf of United Soccer Academy, Inc (herein “USA”), the US Sports Institute, Inc (herein “USSI”), PulseCamps.com (herein "Pulse"), and SoccerSquirts.com (herein "Soccer Squirts"), collectively referred to herein as "Sports Providers".  The Sports Providers operate multiple websites (herein "The Websites") within its family of sports provision including, but not limited to: www.USsportsInstitute.com, www.UnitedSoccerAcademy.com, www.USAsportGroup.com, www.SportsSquirts.com, www.SoccerSquirts.com, and www.PulseCamps.com. 

I agree that I am entering an agreement with the Sports Providers to provide me with products or services and understand that Authorize.net is the payment gateway handling my secure transaction and are not in any way responsible or liable for the service provided to me by the Sports Providers and that my credit card statement will detail payment transaction through USA Sport Group.

Terms of Use

By accessing or using The Websites, you (the "User") signify that you have read, understand and agree to be bound by these Terms of Use ("Terms of Use" or "Agreement"), whether or not you have registered as a member on any of The Websites. We reserve the right, at our sole discretion, to change, modify, add, or delete portions of these Terms of Use at any time without further notice. If we do this, we will post the changes to these Terms of Use on this page and will indicate at the top of this page the date these terms were last revised. Your continued use of The Websites after any such changes constitutes your acceptance of the new Terms of Use. If you do not agree to abide by these or any future Terms of Use, do not use or access (or continue to use or access) the products or services, or The Websites. It is your responsibility to regularly check The Websites to determine if there have been changes to these Terms of Use and to review such changes.

Registration and Your Account

In consideration of your use of The Websites, you agree to (a) provide accurate, current and complete information about you and your child or children as may be prompted by any data input method on The Websites; (b) maintain the security of your password and identification; (c) maintain and promptly update your account, and any other information you provide to keep it accurate, current and complete; and (d) be fully responsible for all use of your account and for any actions that take place using your account.

Terms of Sale

Certain products and services are made available to you ("you" or "User") by the Sports Providers (collectively, "us", "we" or "the Company"). By purchasing any products or services you signify that you have read, understand and agree to be bound by the Terms of Sale in effect at the time of purchase ("Terms of Sale").  These Terms of Sale are subject to change without prior written notice at any time, at our sole discretion, and such changes shall apply to any purchases made after such changes are posted to The Websites. Therefore, you should review these Terms of Sale prior to each purchase so you will understand the terms applicable to such transaction. If you do not agree to these Terms of Sale, do not make any purchases with the Sports Providers.

Purchase Qualifications and Account Security 

To make an online purchase with any of the Sports Providers, you must be a Registered User and comply with these Terms of Sale (including the Terms of Use). You acknowledge that you are responsible for maintaining the security of, and restricting access to, your account and password, and you agree to accept responsibility for all purchases and other activities that occur under your account. The Sports Providers sell their online services and products only to those users who can legally make purchases with a credit card. The Sports Providers reserve the right to refuse or cancel orders or terminate accounts, at any time at their sole discretion.

Privacy Policy

Sharing and Usage of Account Information

We will never share, sell, or rent your personal account information or registered data with anyone without your advance permission or unless ordered by a court of law. Information submitted to us is only available to employees managing this information for purposes of contacting you or sending you mail or emails based on your request for information and to contracted service providers for purposes of providing services relating to our communications with you.

Why did you receive information from us?

If you received mail or email from us, (a) your email and or address is listed as being a registered account holder or (b) you have an existing business relationship with United Soccer Academy and or US Sports Institute and have expressly shared this address for the purpose of receiving information in the future.

How can you stop receiving information?

You may contact us at any time and request that your account details be edited or deleted from our system.

How we protect your privacy:

We use security measures such as encryption to protect against the loss, misuse and alteration of data used by our system.

Privacy Policy Changes

If this privacy policy changes in the future, all account holders will be notified of the change and the new policy will be updated on our site.

Refund Policy & Cancellation Policy

If you need to cancel your order, how and where you registered for the program will dictate the cancellation policy which applies:

You registered directly through a Sports Provider (The Websites)

1. If you choose to cancel your registration

Within 2 business days of placing the order: 100% refund or credit, provided no sessions have been attended.
More than 15 days prior to the program start date: 100% credit voucher issued of amount paid.
Between 8 and 14 days prior to the program start date: 50% credit voucher issued amount paid.
Within 7 days of the program start date: no refund or credit will be issued.

 2. Non-Participation

Following the initial class, if you decide your child is not ready for the program or its content, we will issue you with a credit voucher**. The value of the credit voucher will be a maximum of 80% of the initial registration fee paid.  To request a credit voucher for non-participation, you must contact USG offices before the 2nd session / camp day begins.

3. Medical Cancellation

If a medical emergency arises and you submit medical documentation stating that the registrant cannot participate, the Sports Providers will issue a credit voucher* for any time missed (affected dates must be notated on the medical documentation submitted).

You registered through a 3rd party

A 3rd party is an organization other than the Sports Providers such as a Recreation Dept, YMCA, Soccer Club, Preschool or School, etc. All 3rd party organizations have their own cancellation and refund policies. Please contact the organization you registered with for their policy. This policy will be in effect for your registration as per your acceptance of the registration terms when registering.

*Valid for one year, from date of issue, for any program only where the registration is placed directly through one of The Websites or by phone to the Sports Providers offices.

If we cancel the program:

1. Cancelled due to low enrollment

To run a quality camp or class, we do require that a minimum enrollment is met. We do not like to cancel any programs but if we do, you will receive notification from us: 

3 or more days before for weekly classes
5 or more days before for summer camps

2. Cancelled registration due to participant being too young/old for program 

If the coach feels that the participant is not having the best experience or is hindering the experience of other participants, we reserve the right to ask the customer to drop out of the class. In this scenario, a full refund will be issued. 

 

Payment Methods

We accept Visa, MasterCard, American Express and Discover credit cards as forms of payment. By submitting an order through any of The Websites, you authorize the Sports Providers or its designated payment processor, to charge the account you specify for the purchase amount. All payments are to be made in United States Dollars. Our payment gateway adheres to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover to ensure the secure handling of credit card information.

Discounts, Special Offers & Credit Vouchers

The Sports Providers offer the following discounts and special offers to its customers for promotional purposes. We reserve the right, at our sole discretion, to change, modify, add, or delete portions of these discounts and special offers at any time without further notice. 

1. Gold Club Membership 

Gold Club Membership must be purchased at a value specified in the shopping cart pages under the “Terms of Sale”. Once purchased, Gold Membership has zero cash value and cannot be refunded or credited in any way. You must be a registered user of The Websites to purchase a Gold Club Membership, which once confirmed, entitles the customer to a 10% discount on programs where the registration is processed directly through the Sports Provider Websites. The Sports Providers reserve the right to exclude certain products or services from the Gold Club discount program. Gold Club may not be combined with additional promotions or discount programs. 

2. Gift Coupons and Promotional Codes

The Sports Providers will issue gift coupons and promotional codes for certain products, services or to specified Registered Users on either a dollar or percent value. Purchase of gift coupons must be made based on the “Terms of Sale”. We reserve the right to refuse all and any use of promotional codes for misuse. If you have received a gift coupon or promotional code, please note that Recreation Departments or other 3rd party organizations do not typically accept these company discounts or promotions. Your gift coupon or promotional code can be used towards a program on any of Our Websites.

3. Credit Vouchers

If your credit voucher was issued by any of the sports providers:

If you have been issued a credit voucher from any of the Sports Providers, please note that Recreation Departments typically do not accept these company credit vouchers. Your credit voucher can be used towards a program on any of Our Websites. 

If the credit voucher was issued directly from the Recreation Department or 3rd party:

Credit vouchers issued by a Recreation Department or other 3rd party will be assessed for use on Our Websites on a case-by-case basis. There is no guarantee the Sports Providers can accept a credit voucher from a Recreation Department or 3rd party.

Weather Policy

The vast majority of the Sports Providers programming consists of outdoor activities. Registration for any camp or class should come with the understanding that a portion of a camp/class may be impacted or canceled due to adverse** weather conditions.

If a program is impacted by weather, where you registered for the program will dictate the weather policy which applies.

You registered directly through a Sports Provider:

Weekly Classes:
Class cancelled due to weather?  If an entire session or more is lost and we are unable to offer a make-up session at the end of the program, we will issue a credit voucher valid on any future program. 

Summer  & School's Out Camps:
Day of camp get washed out?  If an entire session/day or more of camp is lost and we are unable to offer make-up times during the camp week, we will issue a credit voucher valid on any future program.

You registered through a 3rd party

A 3rd party is an organization such as a Recreation Dept, YMCA, Soccer Club, Pre School or School etc. All 3rd party organizations have their own cancellation and refund policies. Please contact the organization you registered with for their policy.

**Adverse weather conditions include (but are not limited to) any of the following: excessive heat, excessive snow or snow accumulation, persistent rain, thunder and lightning, excessive/dangerous winds, or field closures (where the Recreation Department, town or 3rd party organization closes the field/facility due to adverse weather conditions).

Waiver and Hold Harmless Agreement - United Soccer Academy, Inc.

When you register with United Soccer Academy, Inc. directly or via www.USAsportGroup.com you agree to the following: You agree to list all additional medical information by enclosing an additional written documentation when registering. I hereby agree to let my child participate in the sport of soccer. I understand that there are certain risks of injury inherent in the practice and play of this sport, as well as in traveling and other related activities incidental to my participation, and am willing to assume these risks. I hereby certify that my child is fully capable of participating in the sport of soccer and that he/she is healthy and has no physical or mental disabilities or infirmities that would restrict full participation in this activity, except as included in writing with this application. In addition to giving full consent for my child's participation, I do hereby waive, release and hold harmless United Soccer Academy, Inc, the US Sports Institute, Inc, its officers, coaches, sponsors, supervisors and representatives for any injury that may be suffered by my child in the normal course of participation in the sport of soccer and the activities incidental thereto, whether the result of negligence or any other cause. I grant permission for my child to receive emergency medical treatment. I grant United Soccer Academy, Inc permission to use photographic or video images of my child in future promotional materials.

Waiver and Hold Harmless Agreement - US Sports Institute, Inc.

When you register with US Sports Institute, Inc. directly or via www.USAsportGroup.com you agree to the following: You agree to list all additional medical information by enclosing an additional written documentation when registering. I hereby agree to let my child participate in this activity. I understand that there are certain risks of injury inherent in the practice and play of this sport, as well as in traveling and other related activities incidental to my participation, and am willing to assume these risks. I hereby certify that my child is fully capable of participating in the sport and that he/she is healthy and has no physical or mental disabilities or infirmities that would restrict full participation in this activity, except as included in writing with this application. In addition to giving full consent for my child's participation, I do hereby waive, release and hold harmless US Sports Institute, Inc, United Soccer Academy, Inc, its officers, coaches, sponsors, partners, supervisors and representatives for any injury that may be suffered by my child in the normal course of participation in the sport and the activities incidental thereto, whether the result of negligence or any other cause. I grant permission for my child to receive emergency medical treatment. I grant US Sports Institute, Inc permission to use photo or video images of my child in future promotional materials.

Waiver and Hold Harmless Agreement - Pulse Camps

When you register with Pulse Camps directly or via www.USAsportGroup.com you agree to the following: You agree to list all additional medical information by enclosing an additional written documentation when registering. I hereby agree to let my child participate in this activity. I understand that there are certain risks of injury inherent in the practice and play of this sport, as well as in traveling and other related activities incidental to my participation, and am willing to assume these risks. I hereby certify that my child is fully capable of participating in the sport and that he/she is healthy and has no physical or mental disabilities or infirmities that would restrict full participation in this activity, except as included in writing with this application. In addition to giving full consent for my child's participation, I do hereby waive, release and hold harmless Pulse Sports, US Sports Institute, Inc, United Soccer Academy, Inc, its officers, coaches, sponsors, partners, supervisors and representatives for any injury that may be suffered by my child in the normal course of participation in the sport and the activities incidental thereto, whether the result of negligence or any other cause. I grant permission for my child to receive emergency medical treatment. I grant Pulse Sports permission to use photo or video images of my child in future promotional materials.

Waiver and Hold Harmless Agreement - Soccer Squirts

When you register with Soccer Squirts directly or via www.USAsportGroup.com you agree to the following: You agree to list all additional medical information by enclosing an additional written documentation when registering. I hereby agree to let my child participate in this activity. I understand that there are certain risks of injury inherent in the practice and play of this sport, as well as in traveling and other related activities incidental to my participation, and am willing to assume these risks. I hereby certify that my child is fully capable of participating in the sport and that he/she is healthy and has no physical or mental disabilities or infirmities that would restrict full participation in this activity, except as included in writing with this application. In addition to giving full consent for my child's participation, I do hereby waive, release and hold harmless Soccer Squirts, US Sports Institute, Inc, United Soccer Academy, Inc, its officers, coaches, sponsors, partners, supervisors and representatives for any injury that may be suffered by my child in the normal course of participation in the sport and the activities incidental thereto, whether the result of negligence or any other cause. I grant permission for my child to receive emergency medical treatment. I grant Pulse Sports permission to use photo or video images of my child in future promotional materials.

Intellectual Property Rights Notice

The contents of this website are protected by copyright and trade mark laws, and are the property of the Sports Providers and/or its licensors. Unless otherwise stated, the copyright and other intellectual property rights in all material on this website (including without limitation photographs and graphical images) are owned by the Sports Providers and/or its licensors.

Severability

To the extent that there are any gaps in these terms of use or that any of their provisions are or become ineffective, the effectiveness of the remaining provisions shall not be affected thereby.

Miscellaneous

Any waiver of these Terms must be in writing and signed by the Sports Provider to be valid. A waiver of any provision hereunder shall not operate as a waiver of any other provision, or a continuing waiver of the same provision in the future.

These Terms represent the entire understanding and agreement between you and Sports Providers relating to use of this website, and supersede any and all prior statements, understandings, and agreements whether written or oral between you and Sports Provider  relating to use of this website, and shall not be modified except in writing, signed by you and Sports Provider.
